TERMS AND CONDITONS

These Terms & Services (“Agreement”) govern all photography services provided by Novasoul Photography LLC (“Photographer,” “we,” “us”) to the client (“Client,” “you”). By booking services, paying a retainer, or signing a contract, you agree to the terms outlined below.

1. Booking & Retainer

• A non-refundable retainer of 50% is required to secure your wedding date. No date is reserved without receipt of the retainer and a signed contract.
• The remaining balance is due 15 days prior to, unless otherwise agreed upon in writing.

Failure to pay the balance on time may result in cancellation of services without refund of the retainer.

2. Cancellation & Rescheduling

• The retainer is non-refundable under all circumstances. This includes cancellations, postponements, or changes of heart.
• If the wedding is rescheduled and Novasoul Photography LLC is available for the new date, the retainer may be transferred once, at our discretion.
• If we are unavailable for the new date, the retainer is forfeited.

3. Coverage & Overtime

• Coverage begins and ends at the times agreed upon in your contract.
• Overtime coverage is billed at $175 per hour and must be paid in full before final images are delivered.

4. Artistic Style & Editing

• You acknowledge that you are familiar with Novasoul Photography LLC’s style and portfolio and trust our artistic judgment.
• Editing style, color tones, black & white conversions, cropping, and overall aesthetic are at the sole discretion of the Photographer.
• Requests for re-edits beyond our standard style may incur additional fees.

5. Deliverables & Turnaround Time

• Final edited images will be delivered via an online gallery within 6-8 weeks..
• Turnaround time may vary during peak wedding season.
• RAW files are never released under any circumstances.

6. Client Responsibilities

• The Client is responsible for obtaining permission to photograph at all venues and locations.
• The Client agrees to provide a realistic timeline, shot priorities, and contact information for a designated point person on the wedding day.
• Novasoul Photography LLC is not responsible for missed images due to late timelines, venue restrictions, uncooperative guests, or circumstances beyond our control.

7. Limit of Liability

• In the unlikely event of equipment failure, illness, emergency, or other unforeseen circumstances preventing coverage, liability is limited to a full refund of all monies paid.
• Novasoul Photography LLC is not liable for consequential damages, emotional distress, or loss beyond the amount paid.

8. Force Majeure

Novasoul Photography LLC shall not be held responsible for events beyond reasonable control, including but not limited to acts of God, extreme weather, government restrictions, strikes, or public health emergencies.

9. Copyright & Usage Rights

• All images remain the copyrighted property of Novasoul Photography LLC under U.S. Copyright Law.
• The Client is granted a personal-use license to print and share images for non-commercial purposes.
• Images may not be altered, filtered, cropped, or used commercially without written permission.

10. Model Release

• The Client grants Novasoul Photography LLC permission to use images for portfolio, website, social media, advertising, publication, and promotional purposes.
• If the Client wishes to opt out of image usage, this must be requested in writing prior to the wedding date and may incur an additional fee.

11. Harassment-Free Working Environment

Novasoul Photography LLC reserves the right to end coverage immediately if subjected to unsafe conditions, harassment, or inappropriate behavior. No refunds will be issued in such cases.

12. Image Storage & Archiving

Novasoul Photography LLC archives final wedding galleries for a limited time after delivery. After the archive period has expired, galleries may be permanently deleted.

If the Client requests that a gallery be re-uploaded, restored, or re-delivered after the original delivery or archive period, a Gallery Re-Upload Fee will apply.

• Re-uploading a gallery is subject to availability of archived files.
• Fees start at $100 per request.
• Payment must be received in full before re-upload or re-delivery.
• Novasoul Photography LLC is not responsible for maintaining permanent backups on behalf of the Client.

13. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the state in which Novasoul Photography LLC is registered.

14. Acceptance of Terms

By booking Novasoul Photography LLC, the Client confirms they have read, understood, and agree to all terms outlined in this Agreement.
